HIO Power LLC, which operates the HIO Battery brand (“HIO Battery,” “we,” “our,” or “us”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit hiobattery.com, use the HIO Battery mobile application (“App”), purchase our products, create or use an account, register a product, submit a warranty or support request, communicate with us, or otherwise interact with HIO Battery.

1. Information We Collect

The information we collect depends on how you interact with us and may include:

• Contact information, such as your name, business name, email address, telephone number, billing address, and shipping address;
• Customer, dealer, wholesale, fleet, or commercial account information;
• Order and transaction information, including products purchased, payment status, shipping, pickup, tracking, returns, refunds, and cancellations;
• Product registration, warranty, and support information, including product model, serial number, purchase date, vehicle information, installation details, troubleshooting information, photos, videos, screenshots, and uploaded documents;
• Communications sent through email, telephone, text message, website forms, social media, the App, or customer support; and
• Website and device information, such as IP address, browser type, device type, operating system, approximate location inferred from IP address, pages viewed, links clicked, cookie identifiers, and website activity.

HIO Battery App Information

When you register for or use the App, we may process:

• Your email address and limited authentication, login, account-security, and session information;
• Technical information such as device type, mobile operating-system version, App version, IP address, and connection status;
• Limited battery and device information needed to establish Bluetooth connections, verify compatibility, and support App functions; and
• Information necessary to provide over-the-air (“OTA”) firmware updates, which may include a device identifier, serial number, current firmware version, App version, mobile operating-system version, update status, and error or diagnostic information.
• Scanned product or device information, such as a QR code, barcode, serial number, model number, or device identifier.

The App uses Bluetooth to connect to compatible HIO Battery products and display information such as voltage, current, temperature, state of charge, operating status, fault information, and firmware version. Real-time battery information received through Bluetooth is processed locally on your mobile device and is not retained on HIO Battery servers. Limited device, firmware, update, security, or error information may be transmitted to and retained on HIO Battery servers where reasonably necessary to provide App functions, OTA updates, security, troubleshooting, or technical support.

Camera, Photos, and Screenshots

The App may request access to your camera or photos when you choose to capture, save, select, or share an image or screenshot. Images and screenshots saved through the App generally remain on your mobile device. HIO Battery does not receive or retain those images unless you voluntarily upload or send them to us for warranty, troubleshooting, technical-support, or customer-service purposes.

The App does not request access to your device’s precise location and does not currently use push notifications. The App does not currently include Google Ads, the Meta Pixel, or third-party advertising or analytics SDKs. Payment card information is generally processed directly by Shopify, banks, or other payment service providers. HIO Battery generally does not directly store complete payment card numbers.

2. How We Use Information

We may use personal information to:

• Process payments, orders, shipments, deliveries, and pickups;
• Create, authenticate, secure, and manage customer, dealer, and App accounts;
• Operate the App and provide Bluetooth battery-monitoring functions;
• Verify product and firmware compatibility;
• Provide and support OTA firmware updates;
• Provide product registration, warranty service, technical support, and customer service;
• Communicate about accounts, orders, payments, deliveries, returns, warranties, updates, and support requests;
• Administer dealer programs, payment terms, reward programs, and account benefits;
• Improve our website, App, products, services, and customer experience;
• Measure website usage and website advertising performance;
• Detect fraud, unauthorized activity, technical problems, and security incidents;
• Maintain warranty, safety, accounting, tax, customs, and legal records;
• Enforce our agreements and policies; and
• Comply with applicable laws and protect the rights and safety of HIO Battery, our customers, and others.

We may also use aggregated or de-identified information that does not reasonably identify an individual.

3. SMS, Email, and Other Communications

When you provide your mobile phone number and affirmatively opt in through an applicable consent method, you agree to receive text messages from HIO Battery regarding matters such as:

• Customer inquiries;
• Orders and payments;
• Shipping, delivery, and pickup updates;
• Product registration;
• Warranty matters;
• Technical support; and
• Customer service.

Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing goods or services. You may opt out at any time by replying STOP. For assistance, reply HELP or contact us at info@hiobattery.com. We may send one final message confirming your opt-out request.

We do not sell or share mobile phone information, SMS opt-in information, or text-message consent with third parties or affiliates for their own marketing or promotional purposes. We may provide this information to messaging service providers solely to send and manage communications on our behalf.

We may send transactional or service-related emails concerning accounts, orders, payments, shipping, product registration, warranties, safety notices, App functions, OTA updates, and customer support.

Marketing emails will include an unsubscribe method where required. Even after unsubscribing from marketing emails, you may continue to receive necessary transactional, warranty, safety, account, or support communications.

4. Cookies and Website Advertising

On our website, we use cookies, pixels, local storage, and similar technologies to:

• Operate and secure the website;
• Keep users signed in;
• Remember preferences;
• Maintain shopping-cart, checkout, and account functions;
• Understand website usage;
• Measure website and advertising performance;
• Prevent fraud and diagnose technical issues; and
• Support analytics, advertising, and remarketing.

These technologies may include necessary, functional, analytics, and advertising cookies. On our website, we use advertising and measurement technologies provided by Google and Meta, including Google Ads tags and the Meta Pixel. These technologies may collect or receive information such as:

• Pages and products viewed;
• Links or advertisements clicked;
• Shopping-cart, checkout, and purchase activity;
• Device and browser information;
• IP address;
• Cookie or device identifiers; and
• Information about how you arrived at and interacted with our website.

We use this information to measure advertising performance, attribute conversions, create advertising audiences, conduct remarketing, and improve campaigns. Google and Meta may process this information according to their own privacy policies and account settings.

These Google and Meta advertising technologies are used on our website and are not currently included in the HIO Battery App. You may manage cookies through your browser settings and, where available, through privacy or cookie-preference tools provided on our website. Blocking certain cookies may affect account access, checkout, or other website functions.

5. How We Disclose Information

We may disclose personal information to service providers and other parties that help us operate our business, including:

• Shopify, SparkLayer, website hosting, account, and payment-service providers;
• Shipping carriers, freight companies, warehouses, fulfillment providers, and delivery or pickup partners;
• Email, SMS, customer-support, cloud-storage, security, accounting, and automation providers;
• Google and Meta for website advertising, conversion tracking, remarketing, and advertising measurement;
• Dealers, installers, distributors, and service partners when necessary to fulfill an order or provide warranty or technical support;
• HIO Battery employees, affiliated companies, and authorized operations or support teams;
• Government authorities or other parties where reasonably necessary to comply with law, prevent fraud, protect safety, or enforce our rights; and
• A buyer, successor, or adviser in connection with a merger, financing, sale, reorganization, or similar business transaction.

The App communicates with HIO Battery servers to provide account, compatibility, Bluetooth-support, OTA-update, security, and technical functions. We do not sell personal information for monetary consideration. However, under certain U.S. state privacy laws, the use of Google Ads, Meta advertising tools, cookies, and similar website technologies may be considered a “sale,” “sharing,” or processing for targeted advertising, even when no money is exchanged. Where required by applicable law, eligible users may contact us at info@hiobattery.com to submit an applicable opt-out request.

We do not disclose App account information or real-time Bluetooth battery readings to third parties for their own advertising or marketing purposes.

6. Data Retention and Security

We retain personal information only for as long as reasonably necessary to:

• Process transactions and maintain accounts;
• Operate and secure the website and App;
• Provide OTA updates, product registration, warranty service, and customer support;
• Maintain warranty, product-safety, accounting, tax, customs, and business records;
• Prevent fraud and resolve disputes;
• Comply with legal obligations; and
• Protect our legal rights.

Real-time battery information displayed through Bluetooth is not retained on HIO Battery servers. App account information, including the account email address, and limited device, firmware, update, security, login, and error records may be retained for as long as reasonably necessary to operate and secure the App, provide updates or technical support, and comply with legal obligations.

Images and screenshots saved to your mobile device are not retained by HIO Battery unless you voluntarily submit them to us. Order, warranty, product-registration, and serial-number records may be retained for longer periods because of legal, accounting, safety, and warranty requirements.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. However, no internet transmission, Bluetooth connection, mobile application, server, or electronic-storage method is completely secure, and we cannot guarantee absolute security.

7. Your Privacy Rights and Account Deletion

Depending on your state of residence and applicable law, you may have the right to:

• Request access to personal information we maintain about you;
• Request correction of inaccurate information;
• Request deletion of certain information;
• Obtain a portable copy of certain information;
• Opt out of certain sales, sharing, or targeted advertising;
• Appeal a decision regarding a privacy request; and
• Exercise your privacy rights without unlawful discrimination.

These rights may be subject to legal exceptions. For example, we may retain information needed to complete transactions, provide warranty service, maintain product-safety or accounting records, prevent fraud, or comply with legal obligations.

To submit a privacy request, email info@hiobattery.com with “Privacy Request” in the subject line. We may take reasonable steps to verify your identity before completing a request.

Where applicable, you may appeal a decision by replying to our response with “Privacy Appeal” in the subject line.

App Account Deletion

Because users can create an account within the App, users may initiate deletion of their account through the account settings in the App or through our designated account-deletion webpage. Deleting an account will delete or de-identify the email address and other personal information associated with the App account, except for limited information that HIO Battery is permitted or required to retain for legal, security, fraud-prevention, warranty, accounting, or product-safety purposes. Temporarily disabling the account or logging out does not delete the account.

8. Children, International Processing, and Third-Party Services

Our website, App, products, and services are intended for adults and businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that such information has been collected, we will take reasonable steps to delete it.

HIO Battery works with employees, affiliated companies, suppliers, and authorized support teams located in the United States and other countries. Personal information may therefore be processed or stored outside the state or country where it was originally collected.

Our website or App may contain links to or interact with third-party websites, app stores, platforms, carriers, financing providers, or other services. Their own privacy policies and terms apply.

9. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our website, App, products, services, technology, business practices, or legal requirements. When we update this Policy, we will revise the Last Updated date at the top of the page. Where required by law, we may provide additional notice through the website, App, email, account notification, or another appropriate method.
